ATTORNEY GENERAL ABBOTT HALTS UNLAWFUL EL PASO AIR CONDITIONING BUSINESS

AC Experts owner accused of widespread faulty installations, deceptive advertising

EL PASO – Texas Attorney General Greg Abbott has obtained a temporary restraining order against the owner of an El Paso air conditioning business whose faulty installation of residential air conditioning units without a building permit caused hundreds of consumers’ electrical systems to trip circuit breakers and black out services.

Defendant Rockney D. Bacchus and his company, AC Experts, which manufactures residential air conditioning units under the brand names Freus and Luxaire and sells them to the public, are also accused of misrepresenting to consumers that the air conditioning units installed in their residences were new, brand-name products that had passed inspection by a testing agency, when in fact the units had not been tested and were a different brand that often contained used parts. The defendant is also accused of advertising the units for sale at one price and then swindling consumers with a higher price later.

Temporary restraining order against AC Experts

“With the summer heat upon us, Texas consumers must be able to rely on licensed, honorable businesses to provide quality cooling services and installation,” said Attorney General Abbott. “This business took advantage of trusting consumers with a bait-and-switch scheme, and I am determined to provide relief to El Paso consumers by shutting down this unlawful operation.”

According to the lawsuit filed under the Deceptive Trade Practices Act (DTPA), Bacchus allegedly was notified by the City of El Paso that it would not issue building permits to him for a year after he allowed previous building permits to expire or be revoked for not obtaining required final inspections of his installation work by the City Building Permits and Inspections Department. Bacchus continued installing units without a permit, often arranging for other entities to fraudulently obtain a permit on his behalf.

The Attorney General also alleges that Bacchus failed to submit the air conditioning units for required testing by Underwriters Laboratories (UL) before installing them in residences. On numerous occasions, Bacchus allegedly sold and installed units that had not been tested, or he simply affixed an unauthorized seal or mark to the unit himself to falsely represent to the consumer that it had passed testing.

After faulty installation of a unit, the lawsuit alleges, Bacchus often intentionally neglected to ask municipal authorities for final inspection, knowing that the shoddy workmanship would not pass inspection. This failure left the unsuspecting consumer with an unapproved, dangerous air conditioning unit.

Bacchus is also accused of selling and installing air conditioning units that surpassed the size necessary for the square footage of the residence. In these instances, the units were beyond the electrical capacity of the house and caused electrical systems to trip circuit breakers or black out services altogether. He allegedly also sold and installed units that he was not authorized by the manufacturer to install.

The lawsuit also claims that deceptive billboard and newspaper advertisements offering AC Experts’ air conditioning units at a certain price in large, bold print with a small-print disclaimer indicating an additional fee for “permits (if required)” were misleading to consumers as permits are always required for installation.

The lawsuit seeks a permanent shutdown of the operation and civil penalties of up to $20,000 per violation of the DTPA.

Sometimes..

Sometimes you don't realize how lucky you really are.

This is a sad week for the Peltons and Kerrs as one of our friends has gone to Heaven.

We came to know Baby Jaren and his Mom, Melissa, while we had our Baby Luke in the Neonatal Intensive Care Unit at Abilene Regional Hospital. Jaren was there, fighting to live, when we got there on April 16th. He was born on April 7th 2006, a little early just like Luke. But he was having a much harder time and it was sad to think that he might never leave.

We were happy on the day that our Baby Luke could come home, but sad to leave a friend behind. But the fight is now over and Baby Jaren is in a better place. A place with no tubes, no pain, or suffering.

Jaren Kyler Daniel - Gone to be with the Lord - June 25th 2006.

A complete obituary for Jaren can be found at Abilene Reporter News Obitiuaries for 06.28.06.

CYBER CRIMES UNIT’S CHILD PORNOGRAPHY INVESTIGATION RESULTS IN 15 YEAR PRISON TERM FOR CANYON LAKE SEX PREDATOR

Sean Velton McKinley caught trying to e-mail sexually explicit images of young children

CANYON LAKE – Texas Attorney General Greg Abbott’s Cyber Crimes Unit investigation of a Canyon Lake man who was distributing sexually explicit images of children from his home computer has resulted in a 15-year federal prison sentence for Sean Velton McKinley, 50.

Prosecutors with the U.S. Attorney’s office, working with prosecutors from Attorney General Abbott’s Cyber Crimes Unit, presented the case in the U.S. District Court in Austin after McKinley pled guilty to transportation of child pornography.

“Stockpiling child pornography is a child sex crime that will not be tolerated in Texas,” said Attorney General Abbott. “We will continue our vigorous pursuit of these offenders, and I am deeply grateful to the state and federal authorities who worked to bring this man to justice. I am pleased that he will spend a long time behind bars for his despicable actions, and I appreciate the leadership and cooperation of U.S. Attorney Johnny Sutton to make the state a safer place for Texas families.”

Cyber Crimes investigators conducted a search of McKinley’s Canyon Lake residence after receiving the case from the National Center for Missing and Exploited Children, which received a complaint from an internet service provider that McKinley was attempting to e-mail an image of child pornography to another user. Forensic analysis of McKinley’s computers revealed several images of children engaged in sexual conduct.

He was indicted Jan. 17, 2006, on one count of transportation of child pornography, two counts of receipt of child pornography and one count of possession of child pornography. He has been in custody since his arrest on Feb. 11, 2006.

Upon completion of his prison term, McKinley must register as a sex offender and attend a mental health or sex offender treatment program. He will be banned from using the Internet unless approved by probation officials and prohibited from associating with children under 18 without supervision. McKinley must also refrain from drinking alcohol and buying or possessing sexually stimulating materials.

In 1981, McKinley was convicted in Jefferson County of indecency with a child, a felony offense. In that case, McKinley drove around Beaumont approaching young boys and girls as they walked in their neighborhoods. He solicited their help in "finding his lost dog" and would ask the children to look at a picture of the dog. When the children approached the car, he would expose himself to them.

Attorney General Abbott has made pursuing sexual predators a top priority in his administration. The Cyber Crimes Unit, which targets online predators, has made over 80 arrests since Abbott took office in December 2002. The Fugitive Unit, which locates convicted child sex offenders who have violated the terms of their parole and could be stalking children, has arrested more than 275 such offenders. His office also has obtained convictions against 44 men on child pornography charges.

Walk Across Texas

The Walk Across Texas Task Force met June 22, to plan the Walk Across Texas Celebration. In March, April and May of this year, 128 Coleman County enthusiastic citizens joined forces to see how many times they could walk across Texas in teams of eight. In Coleman County, our miles added up to 17,198 miles. It is about 800 miles across Texas, so Coleman County WAT participants, you have walked across Texas more than 21 times.

Come celebrate with us at the Coleman City Park on Thursday, July 6, at 6 p.m. We will have hamburgers and hot dogs, cooked by Chuck Baker. Bring a side dish or dessert and a lawn chair, if you like. We’ll have certificates for every participant, and prizes, too. It would help us if you could call the County Extension office, 325-625-4519, and let us know how many plan to come, so we can have plenty of meat and buns.

If you have lost weight because of Walk Across Texas, or if you have a success story about how this has helped you, bring that information to the Celebration. Or, you can enter this information online at the WAT Website, at www.walkacrosstexas.tamu.edu. Those are significant pieces of information for the WAT program. Many people have worked hard to make Walk Across Texas the best one ever, this year.

But more than that, you are the ones who have benefited, by increasing your activity and improving your health. Hats off to you, Coleman County! If you missed Walk Across Texas this year, watch for news of it next March. And keep on walking!!
